IMPORTANT DISCLAIMER

The purpose of this policy is to ensure a standard minimum level of support is provided globally for all team members planning to take Parental Leave.

Parental Leave provisions are complex and differ from country to country. You are entitled to and need to comply with your local regulations. They override this internal policy.

This policy is provided for informational purposes and has no legally binding effect on you and MOSTLY AI.

1. What is Parental Leave?

It’s a leave granted to an employee to care for a new baby that just joined, or is about to join, their family. It includes anyone who becomes a parent through childbirth, adoption, surrogation, or foster care.

2. Who is eligible for Parental Leave?

You are eligible for our Parental Leave Policy as soon as you start.

3. How long is the Parental Leave?

Up to 16 weeks for mothers.

Up to 6 weeks for fathers.

The distribution of this leave is up to each employee. It can be used all at once or divided into different portions (Ex: X weeks before the event, Y weeks after the event).

Unless otherwise stated by law in the jurisdiction in which you are hired, Parental Leave and related benefits must be used within the first 12 months* of the birth, adoption, or foster care placement of the child. (*counting from the first day your child joins the family)

Mothers hired via an Employer of Record

As stated by law in the jurisdiction in which you are hired.

If statutory parental leave is longer than the leave offered by MOSTLY AI in the jurisdiction in which you are hired, then we’ll follow the local law.

If the statutory leave is shorter, you’ll be able to take up to 16 weeks, combining paid and unpaid leaves.

Paid by your Employer of Record or local Social Security system, if such statutory parental leave benefit is available in the jurisdiction in which you are hired.

If no statutory parental leave benefit exists, MOSTLY AI will engage with your EOR to try to compensate you in full for up to 12 weeks.

Possible to extend it for 4 additional weeks as unpaid leave.

Fathers hired via an Employer of Record

As stated by law in the jurisdiction in which you are hired.

If statutory parental leave is longer than the leave offered by MOSTLY AI in the jurisdiction in which you are hired, then we’ll follow the local law.

If the statutory leave is shorter, you’ll be able to take up to 6 weeks, combining paid and unpaid leaves.

Paid by your Employer of Record or local Social Security system, if such statutory parental leave benefit is available in the jurisdiction in which you are hired.

If no statutory parental leave benefit exists, MOSTLY AI will engage with your EOR to try to compensate you in full for up to 2 weeks.

Possible to extend it for 4 additional weeks as unpaid leave.

Mothers working as contractors

Up to 16 weeks, combining paid and unpaid leaves.

Up to 12 weeks paid in full by MOSTLY AI.

Possible to extend it for 4 additional weeks as unpaid leave.

Fathers working as contractors

Up to 6 weeks, combining paid and unpaid leaves.

Up to 2 weeks paid in full by MOSTLY AI.

4. What happens to my benefits?

Lunch subsidy: not paid

Home office stipend: not paid

Health insurance (if applicable): continues in place

Birthday gift card: paid

Training & Development budget: continues in place

PSOP: please refer to Section 4 “Vesting & Leaver Provisions“ of the Phantom Share Participation Plan. More info about PSOP is also available here.

Commission: if your compensation includes payment of commissions, a list of accounts taken into consideration for potential commission payments need to be agreed with the manager in writing prior the leave.

5. How do I request Parental Leave?

Some countries and teams require more time to put an action plan in place, so to be eligible for paid parental leave, you are required to communicate the news to your Manager and the People team at least 2 months before you plan to go on parental leave.

6. How do I book Parental Leave?

After your Parental Leave request (5.) is reviewed, you will need to register it on:

Please attach the medical certificate. If you don’t have it when booking the leave, please send it via email/Slack as soon as you get it.

We understand that Parental Leave dates may change, so you may adjust your request at a later time, but it’s important to set expectations as soon as possible.

*Note: if you are hired via an Employer of Record, please contact them in advance for advice and to find out the specific procedures/paperwork/notifications in the jurisdiction in which you are hired.

7. What happens if I want to return earlier or take it later than allowed by my local law?

If you would like to continue working after the hard-stop date under the law or return to work earlier than the statutory parental leave, feel free to discuss this with your Manager and People Team. We’ll try our best to accommodate your desire by trying to offer a part-time/flexible schedule and adjusted compensation, as long as it is compliant with your local laws.

We encourage new parents to take the time they need. If for any reason, you may require more time off to take care of your new child, you need to reach out to your Manager to discuss it. We will not extend paid Parental Leave, but you can apply for Unpaid Leave.

8. How will MOSTLY AI manage my return to work?

Your place at MOSTLY AI will be waiting for you! And whilst we understand that your Parental Leave is a time to get to know the new person in your life, your accounts/accesses will continue to be enabled so, if you wish, you can still check what’s going on.

9. What will be my reinstatement?

At the conclusion of the Parental Leave, you will be reinstated to your previous or a similar position with the same status, pay, length of service credit, and seniority as of the date the leave began, unless other team members of equal seniority and status in the same or similar position have been laid off due to economic conditions or other changes in operating conditions during the team member’s leave.

If a team member extends their Parental Leave beyond the statutory period (i.e. the minimum amount of leave entitled to by law), MOSTLY AI cannot guarantee the team member's reinstatement to their previous or a similar position, except where required by applicable law.
